The terms governing your use of the FamFam app.

These Terms and Conditions (“Terms”) govern your use of the FamFam mobile application (“App”) operated by FamFam (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Purpose of the App

FamFam is designed exclusively for legitimate family and household coordination. This includes managing shopping lists, meal plans, calendars, recipes, registers, and related household activities. You agree to use the App only for these intended purposes.

The App must not be used to facilitate, organise, promote, or support any unlawful activity, including but not limited to the sharing of illegal content, coordination of criminal conduct, trafficking, fraud, or any activity that violates applicable local, state, national, or international law.

We reserve the right to determine, at our sole discretion, whether any use of the App falls outside its intended purpose.

2. Eligibility

You must be at least 13 years old to create an account and use the App. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

FamFam is designed for family use. Family member profiles for children may be created and managed by a parent or guardian. Children do not create their own accounts.

3. Accounts and Family Groups

3.1 Account Creation

You may create an account using your email address and password, or by signing in with Apple or Google. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

3.2 Family Groups

FamFam is built around shared family groups. When you create a family, you become the family organiser. You may invite other people to join your family group via invite links. All members of a family group can view and contribute to shared content, including shopping lists, meal plans, calendar events, recipes, registers, and plant schedules.

The family organiser is responsible for managing family membership and may remove members at any time. Removing a member revokes their access to the family's shared data.

3.3 Account Responsibility

You agree not to share your account credentials with others. You must notify us promptly at support@famfam.life if you suspect unauthorised access to your account.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

The App offers a free tier (“Stay Free”) with access to core features, and premium subscription tiers (“FamFam Premium”) that unlock additional features and capabilities. A subscription applies to the entire family group — individual family members do not need separate subscriptions.

4.2 Free Trials

We may offer a free trial period for premium subscriptions. If a free trial is offered, it begins immediately upon subscription. You will be charged at the applicable rate when the trial ends unless you cancel before that date. Any unused portion of the free trial is forfeited if you purchase a subscription before the trial expires.

4.3 Billing

Premium subscriptions are billed through the Apple App Store or Google Play. Subscription management, billing, and purchase history are processed via RevenueCat. By subscribing, you also agree to the payment terms of the relevant app store.

4.4 Pricing

Current subscription pricing is displayed in the App before purchase. Prices are in Australian Dollars (AUD) unless your regional app store displays otherwise. We reserve the right to change pricing with reasonable notice. Price changes will not affect your current billing period.

4.5 Renewals and Cancellation

Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled. To cancel, manage your subscription through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current paid period — you will retain access to premium features until that date.

4.6 Refunds

Refunds are subject to the refund policy of the Apple App Store or Google Play. We do not process refunds directly. If you believe you are entitled to a refund, contact the relevant app store.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

5. User-Generated Content

5.1 Your Content

You retain ownership of all content you create within the App, including shopping list items, recipes, calendar events, register entries, meal plans, and any other user-generated content (“Your Content”).

By using the App, you grant us a limited, non-exclusive licence to store, process, display, and transmit Your Content solely for the purpose of providing and improving the App and its features. This includes processing Your Content through AI features (see Section 7).

5.2 Shared Content

Content you create within a family group is visible to all members of that family. You are responsible for ensuring that any content you share is appropriate and does not infringe on the rights of others.

5.3 Content Removal

We reserve the right to remove any content that violates these Terms, although we are under no obligation to monitor user-generated content.

6. Intellectual Property

The App and all its content — including the software, design, graphics, icons, text, and branding — are owned by or licensed to FamFam and are protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial family coordination purposes. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from any part of the App without our written permission.

7. AI Features

FamFam uses artificial intelligence to power certain features, including grocery categorisation, recipe suggestions, calendar event parsing, and recipe scanning from photos. These AI features are provided as a convenience and are processed server-side via Google Cloud Functions using the Google Gemini API.

You acknowledge that:

  • AI-generated suggestions (e.g. recipe ideas, item categories, parsed events) are automated and may not always be accurate, complete, or suitable for your needs
  • AI features are provided “as is” and we make no warranties regarding the accuracy or reliability of AI-generated content
  • Content you submit to AI features (e.g. shopping list items, recipe photos, event descriptions) is sent to Google for processing, subject to Google's API Terms of Service
  • You should review AI-generated content before relying on it, particularly for dietary, allergen, or health-related information

8. Acceptable Use

The App is provided solely for lawful family and household coordination as described in Section 1. You agree not to:

  • Use the App for any unlawful, criminal, or fraudulent purpose, or in any way that violates these Terms
  • Use the App to store, share, distribute, or coordinate illegal content, substances, or activities of any kind
  • Use the App's shared features (lists, calendars, recipes, registers, or any other content areas) to facilitate, plan, or support criminal conduct
  • Attempt to gain unauthorised access to our systems, other users' accounts, or other families' data
  • Reverse-engineer, decompile, or disassemble any part of the App
  • Use automated tools (bots, scrapers) to access the App or its data
  • Upload or share content that is harmful, offensive, defamatory, or infringes on others' rights
  • Abuse AI features by submitting content intended to manipulate, exploit, or misuse the AI system
  • Share invite links publicly or add strangers to your family group for purposes unrelated to genuine family coordination
  • Interfere with the operation or integrity of the App or its servers

Zero tolerance: Any use of FamFam to facilitate illegal activity will result in immediate account termination and may be reported to the relevant law enforcement authorities.

9. Push Notifications

If you grant notification permission, we may send push notifications including shopping list reminders, dinner check-in prompts, and list completion alerts. You can manage or disable notifications at any time through your device settings or within the App's notification preferences screen.

10. Account Termination

10.1 Termination by You

You may delete your account at any time via Profile → Settings → Delete Account within the App. Upon deletion, your personal data is removed from our systems. If you are the family organiser, you should transfer the organiser role to another family member before deleting your account, or the family group may become inaccessible.

10.2 Termination by Us

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, abused the App, or engaged in fraudulent or illegal activity. We will endeavour to provide notice where reasonably practicable.

In cases involving suspected illegal activity, criminal conduct, or serious misuse of the App (including but not limited to using shared features to facilitate unlawful acts), we may terminate your account immediately and without prior notice. We may also preserve and disclose relevant account data to law enforcement authorities as required or permitted by law.

10.3 Termination of Family Groups

If we determine that a family group is being used for purposes that violate Section 1 (Purpose of the App) or Section 8 (Acceptable Use), we reserve the right to terminate the entire family group and all associated accounts without notice.

10.4 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will continue to apply, including Sections 5 (User-Generated Content), 6 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), and 13 (Governing Law).

11. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The App will be uninterrupted, error-free, or free of viruses
  • AI-generated content will be accurate, complete, or appropriate for any particular dietary, health, or safety requirement
  • Data entered by family members will be accurate or up to date
  • The App will be compatible with all devices or operating system versions

Important: FamFam is a family coordination tool, not a medical, dietary, or safety advisory service. AI-generated recipe suggestions and grocery categorisations should not be relied upon for allergen management or medical dietary requirements. Always verify critical information independently.

12. Limitation of Liability

To the fullest extent permitted by Australian law, FamFam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of content, or inaccurate AI-generated suggestions.

Our total aggregate liability for any claim arising out of or relating to these Terms or your use of the App shall not exceed the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or AUD $50, whichever is greater.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded by agreement.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be addressed by contacting us at support@famfam.life. We will endeavour to resolve disputes informally within 30 days. If the dispute cannot be resolved informally, it shall be submitted to the courts of Queensland, Australia.

14. Third-Party Services

The App integrates with third-party services including Firebase, Google Gemini API, RevenueCat, Brevo, and Open-Meteo. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

The App may also contain links to external websites. We do not control and are not responsible for the content or privacy practices of external websites.

15. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If we make significant changes that materially affect your rights, we will endeavour to notify you via the App or by email.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamFam regarding your use of the App, and supersede any prior agreements or understandings.
